Privacy Policy

NC Smart Money Pty Ltd ("Smart Money") is committed to the protection of your right to privacy. Smart Money has stringent privacy policies and procedures to ensure that your personal information and privacy is protected. Smart Money products and services are available through its network of Licensees, loan writers and other professionals. This Policy also applies to Smart Money (Aust) Licensees and Smart Money Loan Writers and Smart Property Investments Pty Ltd.

Smart Money complies with the National Privacy Principles contained in the Privacy Act 1988 (Cth) ("Act").

As a Smart Money and/or Smart Property Investments client, we collect, use, disclose and hold personal information about you. Your "personal information" is any information or opinion about you that is capable of identifying you.

This Policy is intended to cover most of the ways that personal information is generally handled by Smart Money and/or Smart Property Investments, but is not exhaustive. If you have any queries about Smart Money’s management of your personal information, please contact Smart Money or one of its Licensees for further information.

1. Collection of Personal Information

When collecting your personal information, Smart Money and/or Smart Property Investments takes reasonable steps to make you aware of the purposes for which the information is being collected, the organisations to which Smart Money would usually disclose your information, legal obligations (if any) requiring Smart Money to collect the information, and any consequences if you fail to provide any information that is requested.

Smart Money limits the personal information collected to that which is necessary for Smart Money’s products and services. When reasonable and practicable, Smart Money only collects your personal information directly from you (often through its Licensees and Loan Writers).
Smart Money may collect personal information from you in a number of circumstances, including:
• when you request a Smart Money Report;
• when you enquire about your loan options through Smart Money;
• when Smart Money does a loan application on your behalf;
• when you respond to Smart Money’s marketing activities (such as faxes, advertisements or direct mail); and
• when you contact Smart Money, for example, to enquire about Smart Money’s products or services i.e. insurance and real estate investments.

The personal information that Smart Money may collect includes your name, address, telephone number, and birth date. We may also collect other personal information (such as information regarding your income, assets and liabilities, and expenses) in connection with the establishment and ongoing management of your Smart Money System.

Sometimes Smart Money may need to collect sensitive information about you, which may include information about your residency status or your health. However, Smart Money will not collect sensitive information unless you have consented or we are otherwise permitted to collect this information under the Code or by law.

2. Use of Personal Information

Smart Money and/or Smart property Investments will generally only use your personal information for the purpose for which it was collected, and for related purposes that are within your reasonable expectations. Smart Money will seek your consent prior to using or disclosing your personal information for another purpose, unless we are required or authorised by the Code or by law to do so without seeking your consent.

If you request a Smart Money Report to be done, then Smart Money will use your personal information from the Smart Money Questionnaire to complete a Smart Money Report for you.

If Smart Money looks at your loan options or does a loan application on your behalf, Smart Money will use your personal information from your initial loan enquiry form to determine your eligibility for a loan.  Smart Money will then use your personal information from the loan application to submit a loan on your behalf with the appropriate lender.

Your personal information will not be disclosed to any third parties unless your consent is given. For example if you require insurance then your personal information gathered for your Smart Money Report may need to be provided to an insurance company to obtain a quote.

Your personal information may also be used to enable Smart Money to offer you other products or services that are related to products or services Smart Money has previously provided to you.

If Smart Money collects sensitive information from you, that information will be used in a considerate manner by Smart Money and will be securely and privately stored.

3. Disclosure of Personal Information

Smart Money and/or Smart property Investments may collect personal information from you in a number of circumstances, including:

• Smart Money Licensees, for purposes connected with the completion of your Smart Money Report;
• Smart Money Licensees and Loan Writers, for the purpose of providing your with a summary of your various loan options with different lenders;
• Smart Money Licensees or Loan Writers, for the purpose of completing and submitting a loan application on your behalf;
• credit reporting agencies, for the purpose of obtaining your credit report;
• other credit providers, for the purpose of obtaining information from them about your credit history;
• third parties such as financial planners, accountants and real estate agents, for the purposes of providing other services thay you may require in connection to your Smart Money Report or loan;
• your solicitor, conveyancer, real estate agent, builder, home insurer, valuer or financial adviser, for purposes connected with your home purchase; and
• contractors or third party service providers (for example mail houses and archive companies), for purposes such as sending materials to you.
When Smart Money engages contractors and third party service providers to provide specialised services such as financial planning services, these contractors and service providers may only use personal information disclosed to them by Smart Money for the specific purposes for which it was provided.
Smart Money will not sell your personal information to any third parties.

4. Access to Personal Information

You are entitled to obtain access to the personal information about you held by Smart Money. Smart Money may deny your request for access if required or authorised to do so under any law. A request for access to your personal information must be in writing and sent either to Smart Money or to your Smart Money Licensee or Loan Writer (who will forward it to Smart Money). Smart Money will respond to your request within 30 days of receiving the request.
